The recently printed budget bill for Transportation includes an amendment to DERA that will extend the compliance date for DERA through December 31, 2012.

The bill requires that all vehicles covered by the law shall have best retrofit technology on or before December 31, 2012. The change will be effective immediately upon passage of the budget, which is expected to be on or before April 1, 2011.

All other provisions of the existing regulations remain the same. The budget bill does not address on-going concerns regarding who is required to comply with the regulations.
